Business Terms of Service

Version 2026-09-06Effective September 6, 2026

Important: These terms govern business use of Febs services. Please read them before creating an account.

1. Who provides the service

The service is owned and operated by Franck Benites, an individual operating under the brand Febs Company, from Nassau County, New York, United States ("Febs," "we," or "us"). Febs Company is a trade or brand name and is not represented as a corporation, limited liability company, or legal entity separate from Franck Benites. Your agreement is directly with Franck Benites as the service operator. Contact: support@febscompany.com.

2. Business accounts and authority

The service is intended for business use. You must be at least 18 and authorized to act for the business you register. If you register for yourself, you are the customer; if you validly act for an organization, that organization is the customer. You must provide accurate account details, protect credentials, manage user permissions, and promptly report suspected unauthorized access. You are responsible for users you authorize, but this does not excuse security failures attributable to Febs.

3. Workspace and service scope

Febs Rentals & Delivery supports rental operations, bookings, inventory, deliveries, and pickups. Febs OfficeDesk focuses on company administration, customers, jobs, invoices, payments, balances, and reports, not delivery operations. Features depend on the selected workspace and contracted service. Febs supplies software, not transportation, rental goods, accounting, legal advice, tax advice, insurance, or a guarantee of payment by your customers.

4. Trial and manual purchase

New eligible accounts receive a 30-day free trial. The trial does not automatically become a paid subscription and does not authorize automatic charges. To continue paid service, contact us and expressly agree to the offer. Price, term, included features, payment method, cancellation, and any refund conditions must be disclosed before purchase. These Terms alone do not authorize a payment or future recurring billing. Trial expiry may restrict access; it does not itself authorize immediate deletion of your data.

For website service inquiries: WhatsApp +1 (516) 728-2896 or email support. If a purchase is separately made through an app marketplace, the applicable marketplace purchase and refund rules also apply. Nothing here overrides mandatory refund or consumer rights.

5. Your logos, photographs, and other content

You retain your rights in logos, trademarks, photographs, documents, descriptions, and other content you submit. You represent that you own that content or have sufficient rights and permissions to upload it and authorize its use in the service, including any necessary permissions from photographers, trademark owners, and depicted persons. Do not upload infringing or unlawful content.

You grant Febs a limited, nonexclusive license to host, copy, process, transmit, and display that content only as reasonably necessary to provide the service you request, provide authorized support, maintain security, and meet legal obligations. Service providers may exercise these permissions only to perform those functions for Febs. This is not a transfer of ownership and does not grant permission to use your brand in Febs advertising or public testimonials without separate permission. After termination, permissions continue only for legitimate retention, backup, security, or legal purposes described in the privacy notice or required by law.

6. Customer and employee information

You are responsible for having an appropriate lawful basis and giving required notices and obtaining required permissions for personal information you provide, including your customers' contact details, addresses, orders, and employee or driver information. Use only data reasonably needed for the service. Do not use the platform for unlawful surveillance, unsolicited communications, or unauthorized disclosure. Do not upload passwords, complete payment-card credentials, Social Security numbers, or regulated medical records unless a separate written agreement expressly supports that use.

Febs remains responsible for its own applicable privacy, security, and breach-response duties. These Terms do not transfer those obligations to you or authorize sale or unrelated advertising use of your customers' data. The Privacy Policy explains processing and requests. Additional data-processing terms may be needed for your jurisdiction or intended use; contact support before that use.

7. Records, taxes, and operational decisions

You must review invoice content, rates, tax settings, totals, payment entries, recipients, and operational decisions before relying on them. The software does not determine your tax obligations or replace professional advice. Maintain copies of critical business records. This responsibility does not remove Febs' duties under applicable law or any express written commitments.

8. Integrations and delivery permissions

Optional integrations may depend on third-party availability, permissions, and terms. You are responsible for authorizing connections and informing affected users where required. Device location and notification permissions should be managed through the relevant app and device settings. Driver tracking must be lawful and transparent. Febs does not guarantee third-party uptime and is not responsible for third-party acts beyond its control, but remains responsible for its own conduct.

9. Acceptable use and reports

Do not access other tenants' data, compromise security, upload malware, infringe rights, or use the service illegally. Report suspected infringement to support with your contact information, identification of the protected work or right, the specific disputed content and its location, and the basis of your complaint. We may investigate, request information, restrict access, or remove content as appropriate, with an opportunity to respond where practical. This contact is not a representation that Febs has a registered DMCA agent or qualifies for any statutory safe harbor.

10. Availability and suspension

Unless separately agreed in writing, no specific uptime or support-response time is promised. Maintenance, defects, and interruptions can occur. To the extent allowed by law, the service is provided as available without implied warranties, including merchantability, fitness for a particular purpose, or noninfringement. This does not negate express commitments or nonwaivable rights. We may restrict service for material breach, nonpayment of an agreed charge, unlawful use, or a credible security risk. Where practical, we will explain the reason and allow correction before suspension, except where urgent action or legal restrictions prevent this.

11. Cancellation and data requests

You may request cancellation, available export assistance, or account deletion through support. Because the trial does not renew automatically, ending a trial does not create a charge. Any paid period, renewal, cancellation date, and refund eligibility are governed by the specific offer you accept and mandatory law. Unless that offer or applicable law states otherwise, cancellation stops future service and does not retroactively refund a period already supplied. We will describe available export options when handling a request. Data may remain for a limited period where reasonably necessary for security, backups, legal compliance, accounting, or dispute resolution, as explained in the Privacy Policy. No particular export format or indefinite storage is promised.

12. Third-party claims arising from customer misuse

To the extent permitted by law, the business customer will indemnify Febs for reasonable amounts finally awarded or agreed in an approved settlement, including reasonable legal costs, for third-party claims directly arising from content the customer supplied without required rights, unlawful processing directed by the customer, or the customer's material unlawful misuse of the service. This does not cover claims caused by Febs' own breach, negligence, misconduct, or failure to meet legal obligations. Febs must promptly notify the customer, allow reasonable participation in the defense, cooperate, and mitigate losses. Neither party may settle in a way that admits fault or imposes nonmonetary obligations on the other without its written consent, not unreasonably withheld.

13. Limits of liability

To the extent permitted by law, neither party is liable to the other for indirect, special, or consequential damages arising from this service. Subject to the exceptions below, Febs' aggregate liability for service-related claims is limited to the greater of US $100 or the fees paid to Febs for the service during the 12 months preceding the event giving rise to the claim. Related claims do not multiply that limit.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or any liability that applicable law prohibits limiting or excluding. They do not eliminate mandatory privacy, data-security, consumer, or other statutory rights or remedies. No clause guarantees immunity from claims or lawsuits.

14. Governing law and disputes

New York law governs these Terms, except where mandatory law requires otherwise. Subject to jurisdictional requirements and nonwaivable rights, disputes may be brought in competent state courts in Nassau County, New York, or federal courts in the Eastern District of New York. You may contact support to seek an informal resolution, but doing so is not a condition that prevents filing a timely legal claim. These Terms do not impose mandatory arbitration or a class-action waiver.

15. Updates and acceptance records

Material changes will be brought to your attention before they apply, with fresh acceptance where required. New terms are not retroactively applied to an existing dispute. An invalid provision does not invalidate the remainder where legally separable. We record the accepting account, time in UTC, version, and exact text of the documents presented to demonstrate acceptance and acknowledgment. Accepting service terms is not consent to marketing.
